We commit to clearly explaining, whenever necessary, how KW Portugal will use your data to ensure that you find the home, office, or store you are looking for on our Platform. It is also our commitment that all information collected will be securely stored, both by KW Portugal and by the other partner entities with whom we work.
 
This Privacy Policy seeks to explain which personal data we collect about our users, how and why we use it, with whom we share it, and how we protect your privacy.

KW Portugal collects personal data from users, for example, when they contact us through the forms available on the Platform, browse our Website (even if they are only searching for Apartments, Houses, or Offices), or contact us by phone. We may also receive users’ personal data from our partners who provide services on our behalf (for example, when recommending our real estate portal to someone who is looking for a new home, based on the form we provide for that purpose).

 Technical information, in particular, the Internet Protocol (IP) address of the device the user is using to access the Platform, the time zone, the operating system, and the type and version of the browser used.

Information about your visit, including the websites from which you access our Website and the websites accessed from our Platform, the date and time of your visit, properties viewed, Market Centers and Real Estate Consultants viewed, services viewed, visit duration, page response time, interactions with the available functionalities, and other data related to your interaction with the Platform.

The use of the Platform may be monitored (the selection of monitored sessions is entirely random and secured by a KW Portugal partner) so that usage patterns of the Website can be analyzed and interpreted in an aggregated and anonymous manner, thus improving service levels and meeting our users’ expectations.
 
If you wish to limit the information that KW Portugal automatically collects each time you use our Website, please refer to our Cookies Policy. Note that limiting the collection and use of your personal data may prevent KW Portugal from providing the service offered on its real estate portal.
 
 

3. Purposes of the Collected Personal Data

 Based on the information provided by users on the KW Portugal Platform, the Data Controller will process your data in order to achieve the following objectives:
 

  • Enable users visiting the KW Portugal real estate portal – under the terms of the Terms and Conditions of Service – to be contacted by the Real Estate Consultants associated with KW Portugal, following the submission of the form on both the property details page and each individual professional’s page;
  • Respond to users who have contacted KW Portugal via its Platform, so that we can clarify any questions they may have;
  • Schedule interviews with candidates seeking additional information about the KW Real Estate Network and the central role played by the Real Estate Consultants, whenever the user has filled out the respective form on the Platform;
  • Forward to a Market Center of the KW Portugal Network all contacts generated by potential clients who have expressed their intention to sell their property, based on the excellence service that KW guarantees, so that these requests can be forwarded to the Real Estate Consultants who are part of their team.


Regarding the information automatically collected by the Website based on our users’ navigation, your data will be processed in order to:
 

  • Create anonymous and aggregated information about the characteristics and behavior of Website users, including for segmentation and the development of anonymous profiles (personas);
  • Improve the performance of the Platform;
  • Provide a more personalized experience so that your real estate search returns the results you truly desire;
  • Measure and monitor the efficiency of the highlights on the Platform;
  • Manage the Platform, ensuring that it becomes increasingly secure and transparent;
  • Ensure that any remarketing activities promoted by the Real Estate Consultants associated with KW Portugal adhere to the highest standards of security and privacy.


4. Your Rights

 Under current legislation, users have the right to oppose, at any time and free of charge, the processing of their personal data for direct marketing purposes or any other form of solicitation. They also have the right to withdraw their consent at any time, without affecting the legality of the processing carried out based on the consent previously given.
 
Users also have the right to be informed before their personal data is communicated to third parties for direct marketing purposes or used on behalf of third parties, and to be expressly given the right to oppose such communications or uses free of charge.

We would also like to remind you that some of the information entered into the Platform may not be under the direct management of KW Portugal, so in these cases we will make every effort to ensure that the requests made by users from the Platform are respected by both the Markets Centres and the Real Estate Consultants associated with KW Portugal (depending on the nature of the information). We also emphasise that KW Portugal does not have any powers of control or instruction over its associated Real Estate Consultants, and therefore cannot guarantee effective or immediate respect for the exercise of their rights.
 

5. Security and Quality of Information

 
Our goal is to ensure the quality and integrity of the information provided by users who visit the KW Portugal real estate portal. To this end, we have implemented the necessary measures—both technological and organizational—to keep the information secure, accurate, up-to-date, and complete.
 
To ensure maximum security, in the areas of the Website where users’ personal data is collected, the transmission of data is encrypted.
 
 

6. With Whom We Share Your Data

Your personal data will not be transferred to third parties unless:
 

  • KW Portugal has your explicit authorization;
  • These entities provide the services offered by KW Portugal to our users under a contractual agreement;

KW Portugal employees and its associated Real Estate Consultants may have access to your personal data for the management of the Platform and are bound by a confidentiality obligation regarding the data they access within the respective IT system.
 
KW Portugal employees and its associated Real Estate Consultants are duly informed of the importance of complying with this legal duty of confidentiality and are responsible for upholding this obligation.
 
By giving your consent, KW Portugal may share or forward your personal data with:
 

  • The Market Centers that make up the KW Real Estate Network;
  • The Real Estate Consultants associated with KW Portugal.


The site uses Google Analytics for Display services, including remarketing. This function displays ads to users who have already visited the Platform.
 
You may choose not to accept Google Analytics for Display Advertisers and thus avoid being exposed to ads from the Google Display Network. To do so, you can access the Ads Preferences Manager and the Analytics Opt-out Browser Add-on.
 
KW Portugal may also promote remarketing practices to advertise online, meaning that users who do not opt out of the Google Display Network through the aforementioned methods may be exposed to KW Portugal ads on Google’s content network. Additionally, third parties like Google or Facebook may use cookies (such as Google Analytics and DoubleClick cookies) to optimize ads based on users’ past visits to the Website.
 
 

7. Where Your Personal Data Is Stored and for How Long

 The data that KW Portugal collects through its Platform will be stored on servers located within the European Union.
 
The period for which the data is stored varies according to the purpose for which the information is processed. KW Portugal will retain users’ personal data as long as they remain active users of the Website. If a user does not interact with any of the functionalities available on the Website for a period of 3 (three) years, their absence from the Platform will be interpreted as a sign of disinterest in maintaining an active record, and KW Portugal will make efforts, together with its network of associated Real Estate Consultants, to delete such personal data from all databases in which it is contained.
 
There are legal requirements that mandate retaining data for a minimum period. Therefore, unless there is a specific legal requirement, the data will only be stored for the minimum period necessary for the purposes that prompted its collection or subsequent processing, or for the period authorized by the National Data Protection Commission, after which KW Portugal will make efforts, together with its network of associated Real Estate Consultants, to delete the personal data from all databases in which it is stored.
 
 

8. Technical and Organizational Measures and Security of Processing

 All information that KW Portugal receives from users of its Platform will be stored on secure servers and, in collaboration with our technological partners, we will implement the necessary technical and organizational measures to ensure that any personal data is protected at an appropriate level of security. This guarantees, in particular, the confidentiality and integrity of the data and prevents accidental or illicit destruction, loss, alteration, or unauthorized disclosure or access.
 
Notwithstanding the measures implemented to protect your data, every user should be aware that the transmission of information via the Internet or other open networks is never completely secure, and there is a risk that data may be seen and used by unauthorized third parties. KW Portugal is obliged to alert all Internet users to adopt additional security measures, such as ensuring that they use a device and a browser that are up-to-date with the necessary security patches, a properly configured firewall, antivirus and antispyware software, and verifying the authenticity of the websites they visit—avoiding those sites whose reputation they do not trust.
